These Terms and Conditions (“Terms”) govern your use of the BhuAkshaya website (the “Platform”), owned and operated from Vijayawada, Andhra Pradesh. By accessing our website, browsing our products, or registering as a customer or vendor, you agree to be fully bound by these Terms. If you do not agree, please do not use our Platform.

1. Eligibility and Accounts

    • Age Requirement: You must be at least 18 years old to create an account or make purchases on this Platform.

    • Account Accuracy: You agree to provide accurate, current, and complete information during registration and keep your account details updated.

    • Account Security: You are entirely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

2. Product Information and Freshness Disclaimer

  • Perishable Goods: BhuAkshaya delivers fresh, natural, and organic products (including fruits, vegetables, meat, and dairy). Because these are fresh items, actual weights, shapes, and colors may vary slightly from the images displayed on the Platform.

  • Home Growing Kits: The “Jeevana Kit” provides a microgreens growing tower and live seeds. Success in growing microgreens depends heavily on user care, watering, and light conditions; BhuAkshaya does not guarantee specific agricultural yields.

  • Availability: All products are subject to seasonal availability. We reserve the right to limit order quantities or cancel orders if items become unavailable due to harvest conditions.

3. Pricing and Payments

  • Currency: All prices listed on the Platform are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.

  • Changes: Prices for our products are subject to change without notice.

  • Payment Gateways: Payments must be made securely via our integrated online payment options (Debit/Credit Cards, UPI, Net Banking). Orders will only be processed upon successful payment confirmation.

4. Shipping, Delivery, and Logistics

  • Delivery Area: We currently offer home delivery services strictly within designated zones in Vijayawada and surrounding areas as specified at checkout.

  • Delivery Failures: If a delivery cannot be completed because you provided an incorrect address, or because no one was available to receive the perishable items at the scheduled time, you may still be charged for the order.

5. Cancellations, Returns, and Payouts

  • Perishable Items: Due to the nature of fresh fruits, vegetables, dairy, and meat, cancellations or returns are not accepted once the order has been dispatched.

  • Damaged Goods: If you receive a physically damaged or spoiled item, you must report it to our customer support team within 2 hours of delivery with photographic proof for a partial refund or replacement consideration.

  • Non-Perishables: Hardware components like the Jeevana Kit microgreens tower may be eligible for returns under our standard Return Policy if defective upon arrival.

6. Vendor Marketplace Terms

  • Platform Role: BhuAkshaya acts as a venue to connect local farmers and independent vendors with consumers. While we run basic quality checks, BhuAkshaya is not directly responsible for the independent vendor-fulfilled stock levels or sudden item variances.

  • Vendor Obligations: Authorized vendors must comply with local agricultural and food safety standards, updating accurate product representations via their designated dashboard.

7. Limitation of Liability

BhuAkshaya, its directors, and its employees shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Platform, delivery delays due to weather, or the consumption of items if handled improperly after delivery.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with this Platform shall be subject to the exclusive jurisdiction of the courts located in Vijayawada, Andhra Pradesh.
